Short-term rental agreement

This Rental Rules & Agreement (the “Agreement”) is a legally binding agreement made and entered into as of the Reservation Date and between the undersigned person(s) or company (the “Primary Guest”) and the undersigned Property owner, manager or agent (“Rental Agent”), pursuant to which the Primary Guest has agreed to rent the Property described below (the “Home”), for the duration of the confirmed length of stay (“Rental Term”) for the total dollar amount (“Rental Fee”) and other good and valuable consideration as described herein.

Definitions

Guest: Any person staying at or visiting the Property with the Primary Guest during the Rental Term.
Primary Guest: Person(s) or company who booked the Property.
Property: The residence made available for rent to the Primary Guest and Guests, for the duration of the Rental Term, and total dollar amount of the Rental Fee and all Non-Refundable Cleaning Fees, confirmed on the Reservation Date.
Owner: The legal owner of the Property.
Guest Registration Form: An online form that each Guest and Visitor must complete and submit in order to confirm the Reservation.
Rental Agent: Person(s) or company that owns or manages the Property or acts as an agent for the owner or manager of the Property.
Rental Term: The duration of the length of stay, confirmed on the Reservation Date.
Reservation Date: The date that the Property was booked or reserved.
Rental Fee: The total dollar amount required to reserve and rent the Property, including a damage deposit, cleaning fee, and applicable taxes, excluding non-refundable Guest Registration fees, and any goods or services.

Scope of the Agreement

Primary Guest and Rental Agent expressly acknowledge that the Agreement and generally, the Property rental, is entered into exclusively between the Primary Guest and Rental Agent, but also binds the any Guest or registered visitor.

Primary Guest Responsibilities

Primary Guest must inform any Guest of the terms and conditions contained herein as well as the terms and conditions contained in these Rental Rules and Agreement. Primary Guest shall be liable, solidarity with Guest, for any and all damages resulting or arising from the non-compliance by Guest of this Agreement.

Rental Agent

Following the booking of the Property, Go to Poconos Rentals, who acts as the Rental Agent’s vacation rental concierge will immediately process the non-refundable Guest Registration fees in the amount provided for on the Property rental listing.

Bookings and Financial Terms for Guests

When you, as a Primary Guest, choose to enter into a transaction for the booking of a Property, you agree and understand that you agree to any terms, conditions, rules and restrictions associated with such Property imposed by the Owner or Rental Agent which are disclosed at the time of booking. You agree to pay the Owner for the Rental Fee for any booking and to pay the Rental Agent for all Non-Refundable Cleaning Fees, Guest Registration Fees and any additional products or services requested. In order to establish a booking, you understand and agree that Owner and Rental Agent reserve the right, in its sole discretion, to obtain: (i) a verification of your credit card; or (ii) pre-authorization via your credit card for the Rental Fee. Owner will collect the Rental Fee in accordance with the terms and conditions of this Agreement and the pricing terms set forth in the applicable booking and booking terms. You also authorize Owner or Rental Agent to charge your credit card or claim on your damage deposit in the event of damage caused at a Home or in the event that there are any energy consumption overages. Once your confirmed booking transaction is complete you will receive a confirmation email summarizing your confirmed booking.

Occupancy

Primary Guest agrees that no more than the maximum number of persons listed on this listing or booking website where the Property was booked shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Primary Guest under this Agreement. All Guests may be asked to complete a Guest Registration Form and any person or visitor at the property that has not completed the Guest Registration Form will not be permitted at the property and can be evicted.

Condition

The Property is provided in “as is” condition. Rental Agent shall use its best efforts to ensure the operation of the advertised amenities in the Property. Rental Agent shall not be held responsible for such item’s failure to work, but will make every effort to correct any issues reported as quickly as possible.

Use of Property

Primary Guest acknowledges that use of amenities such as hot tubs, spas, BBQs or outdoor grills, fireplaces, firepits, decks, bunk beds and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Primary Guest’s and the Guest’s own risks. Primary Guest and Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Primary Guest and any additional Guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Primary Guest and Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property. Guest accepts and assumes all risks involved in or related to the use of the property.

Default

If Primary Guest or any Guest should fail to comply with the conditions and obligations of this Agreement, Primary Guest shall surrender the Property, remove all Primary Guest’s and Guests’ property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Rental Fee shall be made.

Assignment and Sublease

Primary Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or Guests of the Primary Guest and included within the number of and as permitted occupants under this Agreement.

Hot Tubs & Recreational Equipment & Amenities

If the Property that you have reserved includes a hot tub, these can be dangerous. Guests should observe and adhere to all rules and policies as posted at the Property or in your booking information and supervise all children at all times. Children under 12 and pregnant women are advised not to use the hot tub. Lifeguards are not provided. Decks and patios can be slippery when wet and can result in injury to anyone who is not careful. Guest accepts and assumes all risks involved in or related to the use of the hot tub, deck/patio areas, firepit and any recreational equipment of any kind, including but not limited to a BBQ or outdoor grill, pool or ping pong tables, game or sports equipment.

Entry and Inspection

Rental Agent reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property, renters or other authorized persons. If Rental Agent has a reasonable belief that there is imminent danger to any person or property, or that any part of this Agreement is being violated by Primary Guest or Guest, Rental Agent may enter the Property without advance notice.

Maintenance and Access

Rental Agent has the right to enter the Property at any time during Rental Term and will diligently attempt to address maintenance issues as they occur. This is an associated risk of renting a residence or condo and if a maintenance issue occurs that cannot be fixed in a reasonable amount of time or if the Property is unavailable for any reason as determined in Rental Agent’s sole discretion, Rental Agent reserves the right to cancel and refund Primary Guest or offer to relocate Primary Guest to another home at Rental Agent’s sole discretion.

Phone and Internet

Unless otherwise specified, all Properties are equipped with a Wi-Fi internet connection where and when service is available and Rental Agent will provide Primary Guest with any required Wi-Fi passwords. Rental Agent does not guarantee Wi-Fi or internet uptime, speeds or reliability for work or other purposes. Rental Agent does not provide landline phones and suggest that Primary Guest and Guest please use their mobile phone or Wi-Fi enabled phone for calls.

Furnished Rental and Supplies

Rental Agent’s Property is a furnished property that will include bedspreads, linens, blankets, pillows, towels, an equipped kitchen, TV, furnishings unless otherwise specified. A limited supply of paper and tissue products, bath and dish soaps, are provided but will not be replaced if consumed during Rental Term. If there is a special type of item Primary Guest or Guest is accustomed to using, such items should be brought by the Guest.

Weather and Other Unforeseen Events

Rental Agent does not accept liability for any inconveniences, delays or your inability to booking in a Property arising from any temporary or permanent defects or stoppage in supply of water, gas, electricity or plumbing, damage caused by weather, road closures or conditions, construction, natural disasters, disruption or cancellation of your travel, events, conferences or reason for your booking, government orders, pandemics, viruses, illnesses, infestations, water conditions, closings, pollution, acts of God or other reasons beyond Rental Agent’s control. No refunds will be given for any delays, power outages or cancellations due to such conditions.

Excessive Wear and Tear, Noise and Occupancy

If excessive wear and tear is found for the Property, or additional cleaning is necessary due to spills, trash left on site, stains to furniture, carpeting, linens, paint, wallpaper, or flooring, Primary Guest authorizes Rental Agent to charge Primary Guest for additional fees. Primary Guest will be provided with a receipt for any additional fees incurred upon request or as required by local laws or regulations. If at any time the maximum number of the Property’s occupants is exceeded, if we receive information about excessive noise, or any violation of any laws, regulations or terms of this Agreement, then Rental Agent in its sole discretion, has the right to evict Primary Guest and all occupants immediately and to charge Primary Guest a minimum service fee of $250 with no refund for the balance of the Total Rental Rate. If any sign of smoking is discovered, Primary Guest authorizes Rental Agent to charge Primary Guest an additional minimum $500 cleaning fee. Unless the booking for the Property specifically allows pets, if any sign of a pet is discovered, then Primary Guest authorizes Rental Agent to charge Primary Guest an additional minimum $500 cleaning fee. Any charges owed by Primary Guest may be charged by Rental Agent to Primary Guest’s card on file in addition to seeking any relief provided by law.

Damage to Property

Primary Guest authorizes Rental Agent to place hold of up to twenty percent (20%) or the agreed upon security deposit of the Rental Fee on Primary Guest’s credit card, from 48 hours prior to check-in until the cleaning of the Property is done following check-out. Furthermore, Primary Guest authorizes Rental Agent to charge its credit card in the event of damage caused at a Property.

Indemnity

Neither Owner, nor Rental Agent assumes any liability for loss, theft, damage or injury to Primary Guest, Guest, or other occupants in the Property. The Primary Guest and Guest, for himself/herself, their heirs, assignors, executors and administrators, fully release and discharge Rental Agent and Rental Agent’s HOA from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the Primary Guest, Guest or other occupants of the Property as a result of, or in connection with the occupancy of the Property and agree to hold Rental Agent and Owner free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties or liabilities of the parties to this Agreement, or their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.

Notwithstanding anything to the contrary contained in this agreement, under no circumstances whatsoever shall rental agent be liable to primary guest or guest for consequential, incidental, exemplary, punitive, special or indirect damages.

Unavailability of Property

In the event the Property is not available for use during the Rental Term, Rental Agent will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Primary Guest. If such replacement property cannot be found and made available, Rental Agent shall immediately return all payments made by the Primary Guest, whereupon this Agreement shall be terminated and Primary Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement, including, but not limited to, reimbursement of plane fares,

Identification and Compliance

All guests are subject to our identification and risk screening process, which may require the Primary Guest and Guest to provide personal, credit card and other information as determined by Rental Agent prior to booking in the Property. Rental Agent may cancel a booking at any time if Primary Guest or Guest fails to complete the Guest identification and risk screening process as determined in Rental Agent’s sole discretion. Rental Agent does not prefer, limit or discriminate because of race, color, religion, sex, handicap, familial status, or national origin.

Guest Conduct

You understand and agree that you are solely responsible for compliance with any and all laws, rules and governmental regulations that may apply to your use of the Property and any additional services provided by Rental Agent. In connection with your use of the Property and any additional services provide by Rental Agent, you will not (and will not advocate, encourage, or assist any third party to):

Privacy

Primary Guest and Guest must respect the rights and privacy of all other Guests and neighbors. Primary Guest or Guests may not leave any device and other items, including smart phones, that are located in or around the Property and that may be used to monitor, record, or survey Guests or Owners, whether or not such devices are enabled to actively monitor, record or survey. Any violation of these restrictions may result in the violator being banned and evicted from the Property and reported to the appropriate authorities, in accordance with applicable law.

Payment and Cancellations

Rental Agent accepts all major credit cards and bank transfers. The cancellation policies applicable to this booking will be those provided by the third party booking site, such as AirBnB, VRBO or any booking site’s subsidiaries or affiliates.

Guest Code of Conduct

You understand and agree that you are solely responsible for compliance with any and all laws, rules and governmental regulations that may apply to your use of the Property and any additional services provided by Rental Agent. In addition to the terms included herein and in connection with your use of the Property and any additional services provide by Rental Agent, you acknowledge and agree that the following additional terms and conditions apply to the rental of the Property:

  1. Unless otherwise specified in writing by the Rental Agent, the Primary Guest must complete the Guest Registration Form, within 7 days of the Reservation Date and at least 48 hours before the scheduled check-in date. Failure to provide said required information by the Primary Guest may result in the cancellation of the booking, denied entry, or immediate expulsion of the Property and community, performed by a local agent, local security or local authorities, with no refund for the balance of the total Rental Fee and a charge to the Primary Guest of $250.
  2. Unless otherwise specified in writing by the Rental Agent, the Primary Guest must provide a valid credit card at least 48 hours before the scheduled check-in date. Failure to provide said required information by the Primary Guest may result in denied entry, or the cancellation of the booking with immediate expulsion of the Property and community, performed by a local agent, local security or local authorities, with no refund for the balance of the total Rental Fee and a charge to the Primary Guest of $250.
  3. Unless otherwise specified in writing by the Rental Agent, Primary Guest must provide the names of every Guest and visitor of the Property, as well as the email addresses of every Guests and every visitor of the Property who are 18 years of age or older, within 7 days of the Reservation Date and at least 48 hours before the scheduled check-in date. Failure to provide said required information by the Primary Guest and all Guests may result in in the cancellation of the booking, denied entry, or immediate expulsion of the Property and community, performed by a local agent, local security or local authorities, with no refund for the balance of the total Rental Fee and a charge to the Primary Guest of $250.
  4. We have a strict zero tolerance for occupancy violations. Any violations, including, but not limited to the event that any unregistered person is staying at or visiting the Property, may result in denied entry, or the cancellation of the booking with immediate expulsion of the Property and community, performed by a local agent, local security or local authorities, with no refund for the balance of the total Rental Fee and a charge to the Primary Guest of $250.
  5. Unless otherwise specified in writing by the Rental Agent, Primary Guest agrees that no more than 6 vehicles shall be permitted on the Property at any time during the Rental Term. Primary Guest, Guest, visitors or any other occupant of the Property must park their vehicles in the Property’s driveway. Under no circumstances can Primary Guest, Guest, visitors, or any other occupant of the Property park a vehicle on the surrounding streets. Failure to observe these rules may result in the cancellation of the booking with no refund of any portion of the Rental Fee, and your eviction from the property.
  6. Security and Excessive Noise – We are committed to Rent Responsibly standards. The Property is equipped with smart home technology and a 100% privacy compliant decibel monitoring system that help us to respond to potential disturbances without disrupting your stay. The decibel monitoring system is provided by NoiseAware to improve your experience. NoiseAware is a third-party smart home device that measures decibel levels throughout the property and allows us to respond to noise nuisances without disrupting your stay. NoiseAware is 100% privacy compliant, it does not record actual sounds or conversations, it simply monitors the noise level (measured in decibels), and it is required on this property. If at any time we receive information about excessive noise, or any violation of any laws, regulations or terms of this Agreement, or if the decibel levels are recorded above 85dB, then Rental Agent in its sole discretion, has the right to evict Primary Guest and all occupants immediately, performed by a local agent, local security or local authorities, with no refund for the balance of the total Rental Fee and a charge to the Primary Guest of $250. Removing or tampering with the decibel monitor or security camera, will result in the forfeiture of the security deposit in full.
  7. The Primary Guest on file must be 25 years of age or older, unless explicit written consent is provided by the Rental Agent.
  8. All doors must be locked and all air-conditioning units turned up when Primary Guest and permitted Guests are not in the Property.
  9. No parties allowed on the Property.
  10. The use or possession of illegal drugs is not allowed on the Property and is extremely forbidden.
  11. Prostitution is not permitted on the Property and is extremely forbidden, even if legal or de-criminalized.
  12. Smoking is strictly prohibited inside the Property. Any smoking smells left inside the home will be considered a violation and up to $250 can be charged to mitigate the smell.
  13. All bathroom towels must be kept indoors. In the case that a towel is lost, damaged or stained, the Primary Guest will be charged $35.00 per towel from the security deposit.
  14. Bears and other wildlife are prominent in our area. No food/debris shall be left outside the Property.
  15. Only flush toilet paper down the toilet (no food, tissues, female sanitary products, wrappers, etc.). The property is on a septic system.
  16. All pots and pans shall be hand-washed. It is forbidden to place pots and pans in the dishwasher. All used dishes shall be placed in the dishwasher.
  17. Leave No Trace — We do not require guests to perform a ‘deep’ clean, however, out of mutual respect, we do require that Guests leave the home as tidy as possible, with all garbage, recycling, and compost being properly disposed of. Also, all cookware must be cleaned and stored back to its original place, with all used dinnerware and glassware placed in the dishwasher. All furniture, linens, and towels must also be put back in their original place. Failure to rectify and reimburse all damages to the property and its items before the 10:00am local check-out time, will result in us filing a claim for the total dollar amount of the unpaid damages. Once the claim is filed, our legal insurer may report the unpaid debts to a credit reporting agency and initiate collections for the full dollar amount of the damaged property.
  18. Unless otherwise specified in writing by the Rental Agent, no pets are allowed on the Property. Registered service animals may be permitted if you provide proof of registration, at Rental Agents absolute and sole discretion.
  19. No person under 18 years of age is allowed on the Property without supervision.
  20. Rental Agents have the right to force Primary Guest and Guests to leave the Property, and Primary Guest and Guests hereby agree to leave the Property, without refund if Primary Guest or Guest conducted illegal activity, or are suspected of conducting illegal activity.
  21. Rental Agents have the right to force Primary Guest and Guests to leave the Property, and Primary Guest and Guests hereby agree to leave the Property, without refund if Primary Guest or Guest has broken any of the rules outlined herein and/or outline within the terms and conditions provided by booking channel/website where the Primary Guest confirmed their booking, or is suspected of breaking any of the rules outlined herein and/or outline within the terms and conditions provided by the booking channel/website where the Primary Guest confirmed their booking.
  22. Checking Out Time: Check-out time is 10am. Primary Guest, Guests and visitors hereby agree to leave the Property upon termination of the Rental Term, no later than 10am. In the event Primary Guest, Guest or visitor fail to do so, Rental Agents have the right to immediately evict the Primary Guest and all other occupants from the Property. In the case of eviction performed by local security or local authorities, a charge to the Primary Guest of $250 will be charged to the Security Deposit.
  23. Checking out — Before checking out, please complete the following;
    • Wash and put away all dishes.
    • Wipe off the stove, as well as all counter tops in the kitchen and bathrooms.
    • Take out all trash, including bathrooms. Bag trash and place in the garbage Dumpster located at the top of the driveway.
    • Lock all doors and
      1. In Winter- turn heat down to 62 degrees
      2. In Summer- turn air conditioning up to 80 degrees
    • Please strip used towels, linens sheets and duvet covers off beds. Place those in the laundry room downstairs.
    • Make sure all remotes are placed back on top of or by its dedicated receiver.
    • If you signed into any applications on any smart devices, make sure to sign out.
    • Tidy up the deck and other outdoor areas and remove any trash.
    • Make sure the grill and all outdoor furniture is placed back to its original state.
    • Make sure to turn all lights and electronics off.
    • Make sure all windows, sliders and doors, are closed and locked.
    • Take one final look around for forgotten items.

General Provisions

This Agreement shall be governed by the laws of Pennsylvania & the United States of America. The words “Rental Agent”, “Primary Guest” and “Guest” shall include their respective heirs, successors, representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waiver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein. This Agreement may be signed in one or more counterparts, each of which is an original, but taken together constitute one in the same instrument. The execution of a payment, online acceptance of these terms, or digital signature shall be deemed a valid signature. Whenever the context so requires, words written in the singular also include the plural and vice versa.
